When you buy goods you have the right to expect: Goods as described - goods fit for the purpose intended - goods of reasonable quality and safety.
When you buy a service, you can expect: Quality of service, bearing in mind the price paid - the job done at reasonable cost, in a reasonable time.
If a trader breaches the contract in any of these ways, you may be entitled to compensation.
What can the CAB do?
We can:
Explain any rights you may have to refund or to compensation
Help to get the matter resolved by negotiation if possible
Explain how to use the County Court to enforce your rights
Help you fill in forms; prepare your case and collect all the evidence you need for your case
Explain the meaning of your contract terms
Identify any cancellation rights you may have in your credit agreement
Explain any penalties for late payment of your credit agreement and any benefits from early payment
Draft letters you may need to write, or, if you choose, we can write them for you
Explain the quality you could expect from a trader bearing in mind the price paid
What do you need to do?
You need to:
Bring any written contract you may have together with any letters, which have been written about the matter. A receipt is useful
Try to remember everything that was said at the time of purchase about what you wanted and how you intended to use it. Was anything said about the time in which it should be provided?
We need to know if you have made a complaint to the trader, and if so how, and what was the result?
If the case has reached the County Court we need to see the correspondence you have had with the Court. It shows an essential number, which we need to use if we are to help
If you made the purchase using any form of credit, we need to see details of that agreement
If you made an agreement to buy goods and services on credit in your own home, you may have additional rights to cancel any contract.
